Samantha Markle, 60, has appealed a dismissed defamation lawsuit against the Duchess of Sussex, with oral arguments now scheduled for September 9 in Jacksonville, Florida. The initial case, which stemmed from comments Meghan made in her 2021 interview with Oprah Winfrey, was dismissed with prejudice in 2024. The appeal, however, revives the very public family discord that has long followed Meghan since her entry into royal life.
“A Dark Cloud” Over Harry’s Efforts
Royal commentator Ian Pelham Turner told Fox News Digital the timing of this renewed legal saga could prove especially damaging for Prince Harry, who has reportedly made private overtures to the royal household, including sharing his official engagements with the Palace.
“More legal disputes between Meghan and Samantha could break the fragile links between Harry and Meghan trying to establish a way forward,” Turner said. “The royals are hyper-sensitive toward any legal issues in America, especially when it risks unearthing more secrets damaging to the monarchy.”
British royal expert Hilary Fordwich echoed the sentiment, noting the royal family’s enduring commitment to Queen Elizabeth II’s maxim: never complain, never explain. “There is nothing good about this for Meghan Markle,” Fordwich said. “Whether the allegations are true or not, the optics alone are harmful.”

“A Case Given a Death Sentence”
Samantha Markle’s lawyer, Peter Ticktin, confirmed to Fox News Digital that the appeal seeks to overturn the original dismissal, a decision made by a district court judge in 2024. “We are hoping and somewhat expecting that the panel of three judges on the 11th Circuit Court of Appeals will see the error by the lower court and reverse the dismissal,” said Ticktin.
Legal analyst Jonna Spilbor described the situation as a rare but not impossible scenario. “The case may die another day,” she said. “But that won’t be determined until after the hearing.”
Meghan is not expected to attend the proceedings.
A Private Rift, Public Again
At the heart of Samantha Markle’s lawsuit is Meghan’s characterization of her childhood, including her widely publicized remark to Oprah that she “grew up as an only child.” The court previously found the comment to be a protected opinion rather than a verifiable fact, but Samantha’s legal team continues to argue the statement damaged her reputation.
Samantha also alleged that Meghan’s implication she only reclaimed the “Markle” surname after Harry entered the picture was defamatory. The case, while rooted in familial grievance, remains emblematic of the broader tensions that have followed the Sussexes since stepping back from royal duties in 2020.
Royal Relations Remain in Limbo
Harry’s memoir Spare, which painted an intimate and often critical portrait of royal life, did little to mend ties with the monarchy. Relations with his brother, Prince William, remain icy, according to multiple sources.
Yet recent reports, including one from The Mail on Sunday, suggest Harry may be seeking a new chapter. His aides reportedly met privately with King Charles III’s communications team last month. The King, who was diagnosed with cancer in early 2024, has not made any public comment on a potential reconciliation.
In May, Harry told the BBC: “I would love reconciliation with my family. There’s no point in continuing to fight anymore. I don’t know how much longer my father has.”
Meghan’s Public Image at Risk
While Harry navigates royal diplomacy, Meghan has been focused on her new ventures, including her lifestyle brand As Ever and the Netflix series With Love, Meghan. But according to branding expert Doug Eldridge, personal controversies like the lawsuit continue to pose reputational risks.
“Sadly, changing her distance from her family now would alter the entire narrative she worked to build,” Eldridge noted. “It could deepen the cracks in an already shaky brand foundation she’s trying to fortify.”
Despite her ongoing projects, Meghan has kept silent on the renewed legal challenge. A spokesperson for the Duchess told Fox News Digital there would be no comment.
Whether the appeal succeeds or not, the case has once again spotlighted the deeply personal and persistently public divisions that trail the Duchess. And for Harry, trying to rebuild a royal bridge from across the Atlantic, the timing could hardly be worse.
