Knesset Extends Ban on Legal Representation for Nukhba Terrorists

The Israeli Knesset approved a 6-month extension to the emergency law allowing authorities to block legal access for detainees involved in terrorism during wartime.

In a 58–38 vote, the Israeli Knesset on Monday approved a six-month extension to the emergency regulation that allows security authorities to block legal access for detainees involved in acts of terrorism during wartime.

The regulation applies to prisoners held for hostile activities committed between October 7 and October 13, 2023, as well as detainees connected to ongoing operations in Gaza.

Under the law, Israel’s Shin Bet security agency and law enforcement bodies are permitted to delay access to legal counsel for prisoners deemed a threat to national security.

Critics of the law warned of severe violations of basic rights, while supporters insisted it is an essential operational tool during times of war.

The explanatory memorandum attached to the bill stated: "In light of ongoing security and investigative needs - including new arrests still being made since the last extension - it is proposed to renew the emergency regulations, which allow for the prevention of legal consultation in specific cases, in accordance with law enforcement and national security requirements."

The regulation primarily impacts members of Hamas's Nukhba unit and other terrorists captured since the October 7 massacre, many of whom are held in Israeli prisons.
